Changes In New Mexico Vehicle Insurance Laws
Thursday, February 24th, 2011There’s been a large mix in the state of New Mexico lately concerning uninsured motorist coverage. The squabble was due to a Up to date New Mexico Supreme Court decision in Progressive : Northwestern insurance company vs. Weed soldier Services and Brenda Etcheverry.
The case was really unique in the sense that the insured confounded boundaries on the uninsured motorist coverage equal to the boundaries of culpability on the policy. In other words, they’d higher boundaries of responsibility insurance that they had uninsured motorist insurance. Progressive got all of the written documentation that their attorneys thought judicious at the time and the insured signed a pact to the lower limits for the uninsured motorist coverage. The New Mexico supreme court announced in its call that in order to honour the requirements of the New Mexico uninsured motorist statute that effectively, insurers must provide the insured with the premium charges corresponding to each available option for UM / UIM coverage so the insured can make a knowing and intelligent call to get or reject the total amount of coverage to that the insured is statutorily entitled. As of this writing I know of no insurer in the state that complies with this controlling.
i have been selling New Mexico auto insurance in New Mexico for at least 15 years and I have sold thousands of automobile insurance policies, but I have never seen a refusal form that embodies the premium for coverages supplied but not acquired by the insured. This controlling is extraordinary in its scope and breadth. Essentially, every policy in the state now has uninsured motorist insurance irrespective of whether or not the insured is paying up for the coverage. Some people may agree with the ruling and others may think it a broad overreach on the part of the court, but it is insignificant because
The choice has been made and all our concerns or applause are not likely to change anything. The one thing that we can do is react to it. Insurance firms and attorneys have recently begun reacting to it. There were diverse attorneys in the state that have started new ad campaigns exclaiming that if you have had an uninsured motorist claim anytime in the last 7 years to call and reopen the case because Mr. So and So knows that he’ll get you more money. New Mexico car insurance in the state have witnessed the ad campaigns and have tightened their budgets to make preparations for the attack of new claims. Already a few corporations that were organizing a rate cut in the state have opted to stand pat for awhile longer.
